These Terms of Service ("Terms") govern your use of the East Bay Roofers website at eastbayroofers.com (the "Site") and any roofing services provided by East Bay Roofers ("Company," "we," "us," or "our"). By accessing the Site or engaging our services, you agree to these Terms.

Estimates and Pricing
- All estimates are provided free of charge with no obligation
- Estimates are valid for 30 days from the date issued unless otherwise stated
- Final pricing may differ from estimates if the scope of work changes (e.g., hidden damage discovered during tear-off, additional decking replacement, code-required upgrades)
- Any changes to the scope and price require your written approval before additional work proceeds
- We reserve the right to adjust pricing due to significant material cost changes between estimate and project start
Service Terms
Licensing and Insurance
East Bay Roofers holds California Contractor's License CA #987654. We maintain general liability insurance and workers' compensation coverage on all projects. Certificates of insurance are available upon request.
Project Scheduling
- Scheduled start dates are estimates and may be affected by weather, permit delays, or material availability
- We will communicate any scheduling changes as soon as possible
- We are not liable for delays caused by weather, permit processing, material backorders, or circumstances beyond our reasonable control
Workmanship
- All work is performed in accordance with manufacturer specifications, local building codes, and industry best practices
- We pull all required building permits and schedule necessary inspections
- Our 10-year workmanship warranty covers defects in labor and installation (see our Warranty page for full details)
Your Responsibilities
As the property owner, you agree to:
- Provide accurate information about your property and roofing needs
- Ensure clear access to the work area on the scheduled date
- Move vehicles from the driveway and secure pets during the project
- Obtain HOA approval if required before work begins
- Make timely payments per the agreed schedule
Payment Terms
- A deposit may be required before work begins (typically 10-30% of the project total)
- Balance is due upon completion and final walk-through
- We accept check, credit card, bank transfer, and financing (see Financing page)
- Late payments are subject to a 1.5% monthly finance charge after 30 days
- We reserve the right to file a mechanic's lien on the property for unpaid balances as permitted by California law
Warranties
Warranty terms are detailed on our Warranty page. Key points:
- 10-year workmanship warranty included with every installation
- Manufacturer warranties range from 25 to 50 years depending on the product and warranty tier
- GAF Golden Pledge warranty available (25-year workmanship backed by GAF Corporation)
- Warranties are transferable to subsequent property owners
- Warranty claims must be submitted in writing or by phone to our office
Limitation of Liability
To the maximum extent permitted by California law:
- Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific project giving rise to the claim
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for damage to landscaping, driveways, or other property that results from reasonable and customary roofing operations, though we take all practical precautions
- We are not responsible for pre-existing structural conditions not visible during our initial inspection
Dispute Resolution
- Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation between the parties
- If negotiation fails, disputes shall be resolved through binding arbitration in Contra Costa County, California, under the rules of the American Arbitration Association
- Small claims court actions (under $10,000) are exempt from the arbitration requirement
- California law governs these Terms
Cancellation Policy
- You may cancel a signed contract within 3 business days of signing without penalty, in accordance with California's Home Solicitation Sales Act (Civil Code Section 1689.5)
- Cancellations after the 3-day period may be subject to a restocking fee for materials already ordered and a charge for work already performed
- Emergency tarping and temporary repairs are non-cancellable once work begins
Third-Party Services
Our Site may link to third-party services including financing partners, manufacturer websites, review platforms, and payment processors. We are not responsible for the terms, privacy practices, or content of third-party sites. Your use of those services is governed by their respective terms.
Indemnification
You agree to indemnify and hold harmless East Bay Roofers, its owners, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or misuse of our Site or services.
Changes to These Terms
We may update these Terms at any time. Changes take effect when posted on this page. Continued use of the Site after changes constitutes acceptance. For active service contracts, the terms in your signed agreement govern.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
